We have reviewed the record and the district court’s order and affirm on the reasoning of the district court. See Cooper v. Beeler, No. CA-04-551-5-BO (E.D.N.C. Aug. 25, 2005). We also deny Cooper’s motion for summary judgment. We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process. AFFIRMED - 2 -
