PER CURIAM:* Texas state prisoner (# 552044) Willie Berry, Jr., has appealed the district court’s dismissal of his petition seeking a writ of mandamus directed to a Texas state trial court and one of its judges. This claim is frivolous. See Moye v. DeKalb County Superior Court, 474 F.2d 1275, 1276 (5th Cir. 1973). Because Berry’s appeal is frivolous, it is DISMISSED. See 5TH CIR. R. 42.2. * Pursuant to 5TH CIR. R. 47.5, the court has determined that this opinion should not be published and is not precedent except under the limited circumstances set forth in 5TH CIR.
