Dear Mr. Brown: You have requested our opinion regarding the method of selection of the chairman of the Texas Board of Private Investigators and Private Security Agencies. The original act which created the Board provided, in section 5( 4): one member shall be appointed by the Governor, with the advice and consent of the Senate, who is a citi~zen of the United States and a resident of the State of Texas, and who shall serve as Chairman.
