PER CURIAM: Andrew Hembry appeals the district court’s order denying re- lief on his petition filed under 28 U.S.C.A. § 2254 (West 1994 & Supp. 2000), and a subsequent order denying his motion filed under Fed. R. Civ. P. 59(e). We have reviewed the record and the dis- trict court's orders and find no reversible error. Accordingly, we deny a certificate of appealability and dismiss the appeal on the reasoning of the district court. See Hembry v. Angelone, No. CA- 99-784 (E.D. Va. Mar. 14 & Apr. 21, 2000). We further deny Hembry’s motion for the appointment of counsel. We dispense with oral argument because the facts and legal contentions are adequate- ly presented in the materials before the court and argument would not aid the decisional process. DISMISSED 2
