We have reviewed the facts and arguments of counsel as set
forth in their respective briefs and have been further informed by
the excellent explication of the issues of this appeal by counsel
at oral argument. As a result, we are convinced that the instant
appeal under 28 U.S.C. § 1292 should be and therefore is dismissed.
See Carson v. American Brands, Inc., 450 U.S. 79 (1981); Baltimore
Contractors, Inc. v. Bodinger, 348 U.S. 176 (1955).
