This matter is before the court on the government’s motion to enforce the appeal waiver contained in defendant’s plea agreement. The motion is filed pursuant to United States v. Hahn, 359 F.3d 1315 (10th Cir. 2004) (en banc). In response, defendant’s counsel prepared the equivalent of an Anders brief, see Anders v. Counsel then conceded that the government’s motion is well taken because the appeal falls within the scope of the appeal waiver, defendant knowingly and voluntarily waived his appellate rights, and enforcing the waiver would not result in a miscarriage of justice. 1 See id. at 1325. As part of his plea agreement defendant was accorded fast track status. Accordingly, the government’s motion is GRANTED, and the appeal is DISMISSED.
