PER CURIAM:* Michael J. Battaglia appeals the district court’s denial of his § 2255 motion. He argues that the district court erred in determining that his counsel’s conflict of interest did not have an adverse affect on his defense and in not holding an evidentiary hearing on this issue. See Perillo v. Johnson, 79 F.3d 441, 449 (5th Cir. 1996). The district court did not so err. Accordingly, the judgment of the district court is AFFIRMED. * Pursuant to 5TH CIR.
