PER CURIAM: Walter Columbus Simmons appeals the district court’s order accepting the recommendation of the magistrate judge and dismissing his 42 U.S.C. § 1983 (2006) complaint for failing to state a claim. We have reviewed the record and find no reversible error. Accordingly, we affirm for the reasons stated by the district court. Simmons v. State of N.C. Dep’t of Corr., No. 1:13-cv-00684-WO-JLW (M.D.N.C. Oct. 15, 2013).
