On Rehearing. In passing upon the contract as disclosed by the letter of credit, and accompanying letters to plaintiff and Ardoyno, presented by the pleading, we were addressing ourselves to the case made by the record, and did not intend to foreclose further inquiry of fact, or matters by way of estoppel, which might have occurred subsequent to the issuance of the letter of credit.

Application for rehearing overruled.
