The majority of the court, consisting of ANDERSON, C. J., McCLELLAN, SOMERVILLE, GARDNER, and THOMAS, JJ., are of the opinion that the decision of the Court of Appeals was correct and should be affirmed. This results in a denial of the application for certiorari.
