My dissent in this case is not based so much upon a difference of opinion as to the law, for as to that I am in substantial agreement with my associates, but upon the application of the law to the facts and procedure in the lower court. As this particular situation is not likely to occur again, I do not think it necessary to prepare an opinion presenting my views indicated.
