Taylor v. Finlayson

Assuming that the present appeal opens the question of deficiency decree vel non for review, I am of the opinion that no deficiency decree at all can be entered in a mortgage foreclosure case against persons who did not sign the notes evidencing the mortgage debt, but that the implied liability, if any, of joint adventurers with the mortgagor must be enforced at law.

I concur in reversal.
