I am of the opinion that a cause of action was alleged in count 1 of the petition, and that this count was sustained by the evidence. I dissent from the judgment of reversal wherein it is based on the ground that the evidence did not support the verdict. I concur in the conclusion that count 2 did not set out a cause of action.
