I find myself unable to agree with the majority and therefore respectfully dissent. The case is reversed on the grounds that certain evidence was withdrawn from the jury. I agree with the lower court that the testimony was too indefinite and uncertain to permit the jury to speculate upon it. The case was fairly tried, it was submitted to a jury and I would affirm the lower court.
