I concur on the ground that plaintiff's eligibility to hold the office cannot be tried out in this suit for salary.
Incompetency, if predicated, as here, upon ineligibility, involves no more than ineligibility to hold the office at all, and this can only be tested under an information in the nature of quo warranto. *Page 425
