I concur in the result, but would be better satisfied with a decision simply remanding the case to the district court for proper findings of fact — findings that would be ample and responsive to the determinative issues, particularly that of confiscation. The entire omission of such findings below puts us too much in the position of triers of the facts. *Page 547
