The foregoing opinion of SPERRY, C., is adopted as the opinion of the court. If plaintiff shall make remittitur of the sum of $21.93, on said judgment within ten days after this opinion is handed down, the judgment is affirmed; otherwise said judgment is reversed and the cause is remanded.
