I fully concur in the majority's analysis and disposition of appellant's first assignment of error. I write separately only to note this case is procedurally different from the Lewis Children case and the Wallace Children case cited in the majority opinion, in both of which I dissented. In the case sub judice, the trial court has yet to complete the best interest phase of the hearing.
