To this charge the defendant has pleaded not guilty. You are instructed that the law applicable to this case is as follows: 1. A person commits the offense of assault if he intentionally or knowingly threatens imminent bodily injury to another, including the person's spouse. A person commits the offense of aggravated assault if he commits an assault and the person: 1) exhibits a deadly weapon during the commission of the assault. A person commits aggravated assault on a public servant when the aggravated assault is committed against: I) a person the actor knows is a public servant while the public servant is lawfully discharging an official duty. 2. "Bodily injury" means physical pain, illness, or any impairment of physical condition. A person acts intentionally, or with intent, with respect to the nature of his conduct or to a result of his conduct when it is his conscious objective or desire to engage in the conduct or cause the result. Intent can be inferred by acts done or words spoken, if any. A person acts knowingly, or with knowledge, with respect to the nature of his conduct or to circumstances surrounding his conduct when he is aware of the nature of his conduct or that the circumstances exist. A person acts knowingly, or with knowledge, with respect to a result of his conduct when he is aware that his conduct is reasonably certain to cause the result. 4. This offense is a first degree felony. I. You are instructed that the punishment for Aggravated Assault by use of a Deadly Weapon Against a Public Servant, is confinement in the Texas Department of Corrections Institutional Division for a period of not less than five (5) years, nor more than ninety-nine (99) years or life, and the jury in its discretion, may, if it chooses, assess a fine in any amount not to exceed $10,000, in addition to confinement in the penitentiary. 2. Under the law applicable in this case, the defendant, if sentenced to a term of imprisonment, may earn time off the period of incarceration imposed through the award of good time. Prison authorities may award good conduct time to a prisoner who exhibits good behavior, diligence in carrying out prison work assignments, and attempts at rehabilitation. If a prisoner engages in misconduct, prison authorities may also take away all or part of any good conduct time earned by the pnsoner.
