[*1]The People of the State of New York, respondent,

v

Darren Jones, appellant. (S.C.I. No. 823/18)

Laurette D. Mulry, Riverhead, NY (Gregory Benneditto Haynes of counsel), for appellant.

Timothy D. Sini, District Attorney, Riverhead, NY (Nicole L. Gallo of counsel), for respondent.

DECISION & ORDER

Appeal by the defendant from a judgment of the County Court, Suffolk County (William J. Condon, J.), rendered August 14, 2018, convicting him of criminal possession of a controlled substance in the fourth degree, upon his plea of guilty, and imposing sentence.

ORDERED that the judgment is affirmed.

The defendant's valid waiver of his right to appeal precludes appellate review of his excessive sentence claim (see People v Sanders, 25 NY3d 337, 341-342, People v Lopez, 6 NY3d 248, 255-256; People v Smith, 153 AD3d 1436).

BALKIN, J.P., CHAMBERS, COHEN, CONNOLLY and WOOTEN, JJ., concur.
