(concurring in part/dissenting in part) — I concur with the majority to the extent that it concludes that Barrett has adequately preserved the issue of whether RCW 66.44.200(1) establishes the standard of care for civil cases. However, I cannot agree with the majority’s resolution of this issue and as to that, I am in agreement with the analysis as well as the result set forth in the dissenting opinion.
