(dissenting) — I dissent. When all the questions are analyzed, they are all merely questions of fact, on every one of which, resolved into four propositions by the writer of the majority opinion, there was competent testimony to go to the jury, who were the judges of the weight and credibility of the evidence. The judgment should be affirmed.
