I respectfully concur in the result. I would have preferred to hold this matter in abeyance pending the United States Supreme Court opinion in Toca v. Louisiana, — U.S. -, 135 S.Ct. 781, 190 L.Ed.2d 649 (2014). While I disagree with the holdings in State v. Tate, nevertheless at present we are bound to follow it.
