dissenting. — I cannot concur in the opinion of the court delivered in this case. The act of 1858 only dispenses “ with the use of a scroll or seal in certain cases.” My opinion is that it was only intended to "dispense with such a symbol in private contracts, but not in official or judicial instruments.
