This matter is before the court upon consideration of plaintiff's appeal from the district court's order denying his motions to amend his complaint and for reconsideration of the February 13, 1986, order dismissing his civil rights action. The motion for reconsideration has been construed as a motion filed under Rule 60(b), Federal Rules of Civil Procedure. The matter has been referred to a panel of the court pursuant to Rule 9(a), Rules of the Sixth Circuit.
