Gregory Howard WHITENER, Petitioner-Appellant,
v.
W. F. WATKINS, Superintendent; Attorney General of North
Carolina, Respondents-Appellees.
No. 87-7075
United States Court of Appeals, Fourth Circuit.
Submitted May 21, 1987.
Decided July 15, 1987.
Gregory Howard Whitener, appellant pro se.
Barry Steven McNeill, Office of the Attorney General, for appellees.
Before WIDENER, PHILLIPS and CHAPMAN, Circuit Judges.
PER CURIAM:
A review of the record and the district court's opinion discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. Sec. 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny leave to proceed in forma pauperis, deny a certificate of probable cause to appeal, deny appellant's request for appointment of counsel, dispense with oral argument, and dismiss the appeal on the reasoning of the district court. Whitener v. Watkins, C/A No. 86-185-ST (W.D.N.C., March 3, 1987).
DISMISSED.
