Lew E. WALLACE, III, Plaintiff-Appellant,
v.
Martha P. UPSHUR, Defendant-Appellee.
No. 87-7275
United States Court of Appeals, Fourth Circuit.
Submitted August 20, 1987.
Decided September 21, 1987.
Appeal from the United States District Court for the District of South Carolina, at Columbia. Karen L. Henderson, District Judge. (CA-86-2855)
Lew E. Wallace, III, pro se.
James Warner Alford, Barnes, Alford, Stock & Johnson, for appellee.
Before DONALD RUSSELL, ERVIN and WILKINS, Circuit Judges.
PER CURIAM:
A review of the record and the district court's opinion accepting the recommendation of the magistrate discloses that this appeal from its order refusing relief under 42 U.S.C. Sec. 1983 is without merit. Because the dispositive issues recently have been decided authoritatively, we dispense with oral argument and affirm the judgment below on the reasoning of the district court. Wallace v. Upshur, C/A No. 86-2855 (D.S.C. July 15, 1987).
AFFIRMED.
