dissenting:

Because I cannot say that the trial judge’s factual findings are “plainly wrong” or “without evidence to support *896[them],” Mihas v. United States, 618 A.2d 197, 200 (D.C.1992), or that the trial judge misapplied applicable legal principles, Lee v. United States, 831 A.2d 378, 380 (D.C.2003), I would affirm the judgment of conviction of assault. Therefore, I respectfully dissent.
