I respectfully dissent from the majority opinion herein on the ground that I deem *499said opinion to be in conflict with the decision of the St. Louis Court of Appeals in the case of Carson v. Oxenhandler, Mo. App., 334 S.W.2d 394, and therefore request that this cause be transferred to the Supreme Court.
