David FELTON, Petitioner-Appellant,
v.
Nathan B. RICE, Lacy H. Thornburg, Attorney General of North
Carolina, Respondents-Appellees.

No. 87-7693.

United States Court of Appeals, Fourth Circuit.

Submitted Nov. 18, 1987.
Decided April 18, 1988.

David Felton, appellant pro se.

Barry Steven McNeill, Assistant Attorney General, for appellees.

Before WILKINS, CHAPMAN, and WILKINSON, Circuit Judges.

PER CURIAM:

1

A review of the record and the district court's opinion accepting the magistrate's recommendation discloses that an appeal from its order refusing habeas corpus relief pursuant to 28 U.S.C. Sec. 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, deny leave to proceed in forma pauperis, deny appointment of counsel, dispense with oral argument and dismiss the appeal on the reasoning of the district court. Felton v. Rice, C/A No. 87-25-D (M.D.N.C.Aug. 11, 1987).

DISMISSED.
