Dissenting. — I am still of the opinion heretofore announced by me in this case. I utterly fail to see how, under any recognized rule as to the admission of evidence, the testimony recited in my dissenting opinion could have possibly become admissible. To say that it established a reason for the defendant’s ill-will and hatred of deceased does not, to my mind, answer the objection raised to its introduction.
