People v. Hickey

Judgment of conviction by the Court of Special Sessions reversed upon the law and defendant discharged. This court is of opinion that the information is defective in failing to specify the particular acts constituting the offense charged, and that the evidence on which defendant was convicted was insufficient as a matter of law to sustain such conviction. (People v. Corbalis, 178 N. Y. 516; People v. Lambrix, 204 id. 261.) Blackmar, P. J., Kelly, Jaycox, Kelby and Young, JJ., concur.
