(concurring). I vote to reverse the judgment of conviction and grant a new trial. I concur in the opinion of our presiding justice and also in the statements contained in the opinion of Mr. Justice Heffernan in regard to the summation of the district attorney and the length and lack of clarity of the charge.
Judgment of conviction reversed and indictment dismissed.
