Appeal by one of two defendants in a foreclosure action from an order of the County Court of Suffolk County granting plaintiff’s motion for summary judgment. Order reversed on the law and the facts, with ten dollars costs and disbursements, and motion denied, with ten dollars costs. There are issues of fact to be tried by the court. Lazansky, P.
