UNITED STATES of America, Plaintiff-Appellee,
v.
James Larry FOX, Defendant-Appellant.

No. 89-7155.

United States Court of Appeals, Fourth Circuit.

Submitted: Dec. 28, 1989.
Decided: Feb. 27, 1990.

Appeal from the United States District Court for the Western District of North Carolina, at Shelby. Woodrow Wilson Jones, District Judge. (CR Nos. 86-36-SH, 86-62-SH; C/A No. 88-291-C-SH)

James Larry Fox, appellant pro se.

Max Oliver Cogburn, Jr., Office of the United States Attorney, for appellee.

W.D.N.C.

AFFIRMED.

Before PHILLIPS, Circuit Judge, and HARRISON L. WINTER and BUTZNER, Senior Circuit Judges.

PER CURIAM:

1

James Larry Fox appeals from the district court's order refusing relief under 28 U.S.C. Sec. 2255. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Fox, CR Nos. 86-36-SH, 86-62-SH; C/A No. 88-291-C-SH (W.D.N.C. May 1, 1989). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
