I concur in the principle of law stated in the sixth division of the concurring opinion of the Chief Justice; and that being true, do not think it is necessary, to pass upon the other constitutional questions of law. I also concur in the rulings made *74upon the other issues in the case not involving constitutional questions ; and consequently I concur in the judgment rendered.
