dissenting. I dissent from the rulings made in the seventh headnote and in the corresponding division of the opinion, in so far as they relate to the charges designated as a, b, and c. What is said above in that connection I have stated merely as the views of the majority, and not as representing my own opinion. I think these three charges were error and prejudicial, and that because of the same the judgment refusing a new trial should be reversed.
