Henry Scarborough Todd appeals from the district court's order denying relief on his Fed.R.Crim.P. 35 motion.1 Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Todd, CR-87-65 (M.D.N.C. Dec. 7, 1990). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

The order appealed from was entered December 7, 1990. Todd filed earlier motions with the district court on December 22, 1988, June 18, 1990, and September 7, 1990. Todd failed to file timely notices of appeal from these earlier orders
