Ordered that the judgment is modified, on the law, without costs, by reversing so much thereof as *921granted defendant’s cross motion; cross motion denied, sanctions in the amount of $2,500 are imposed against claimant’s counsel, payable to defendant, and matter remitted to the Court of Claims for further proceedings not inconsistent with this Court’s decision; and, as so modified, affirmed.
