People v. Nelson

Mahoney, P. J., and Casey, J.,

concur in a memorandum by Mahoney, P. J. Mahoney, P. J. (concurring). Although we believe that the arrest warrant which precipitated the events herein was illegally issued (People v Dixon, 147 AD2d 769, 774 [Mahoney, P. J., dissenting] [decided herewith]), defendant made no motion to suppress based thereon and offers no argument in this regard now. Accordingly, we will not address this issue in the context of this appeal.
