Lawrence H. SIMMS, Petitioner-Appellant,
v.
ATTORNEY GENERAL OF THE COMMONWEALTH OF VIRGINIA, Respondent-Appellee,
WARDEN, NOTTOWAY CORRECTIONAL CENTER, Respondent-Appellee.
No. 92-6907.
United States Court of Appeals,
Fourth Circuit.
Submitted: January 25, 1993
Decided: February 16, 1993
Appeal from the United States District Court for the Eastern District of Virginia, at Alexandria. Claude M. Hilton, District Judge. (CA-91-874)
Lawrence H. Simms, Appellant Pro Se.
Robert B. Condon, Assistant Attorney General, Richmond, Virginia, for Appellees.
E.D.Va.
DISMISSED.
Before PHILLIPS and MURNAGHAN, Circuit Judges, and SPROUSE, Senior Circuit Judge.
PER CURIAM:
Lawrence H. Simms seeks to appeal the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. § 2254 (1988). Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court. Simms v. Warden Nottoway Correctional Center, No. CA91-874 (E.D. Va. Aug. 11, 1992). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
DISMISSED
