I should not decide whether appellant established that the testatrix stood in a confidential relationship to appellee or suffered from a weakened intellect when the will was executed, for I am persuaded by reading the record in the light most favorable to appellee that in either event, the resulting presumption that appellee exercised undue influence over the testatrix was rebutted by the testimony of Darra Jellots.
