I concur in the opinion pronounced by the Chief Justice, yet dissent from the suggestion made in that opinion, that an execution cannot be superseded in part and continued in force for the residue. I beiicve the reverse to be the law. Judges Crenshaw, (who did not sit in this cause) and Taxeor, concur with Ate.
Decree reversed and cause remanded.
