Earnest Junior TAYLOR, Petitioner Appellant,
v.
GREENSVILLE CORRECTIONAL CENTER, Respondent Appellee.

No. 93-7133.

United States Court of Appeals, Fourth Circuit.

Submitted: January 20, 1994.
Decided: February 24, 1994.

Appeal from the United States District Court for the Western District of Virginia, at Roanoke. Jackson L. Kiser, Chief District Judge. (CA-93-84-R).

Earnest Junior Taylor, Appellant Pro Se.

Barbara J. Gaden, Office of the Attorney General of Virginia, Richmond, Virginia, for Appellee.

W.D.Va.

DISMISSED.

Before WIDENER, WILKINS, and HAMILTON, Circuit Judges.

PER CURIAM:

1

Appellant seeks to appeal the district court's order denying relief on his 28 U.S.C. Sec. 2254 (1988) petition. Our review of the record and the district court's opinion discloses that this appeal is without merit.* Accordingly, we deny a certificate of probable cause to appeal and dismiss the appeal on the reasoning of the district court. Taylor v. Greensville Correctional Center, No. CA-93-84-R (W.D. Va. Oct. 4, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

DISMISSED

Because the district court considered evidence outside the pleadings, the adjudication was one of summary judgment rather than dismissal. Fed.R.Civ.P. 12(c)
