UNITED STATES of America, Plaintiff Appellee,
v.
David E. TALBERT, Defendant Appellant.

No. 93-6357.

United States Court of Appeals, Fourth Circuit.

Submitted: Jan. 25, 1994.
Decided: March 16, 1994.

Appeal from the United States District Court for the Northern District of West Virginia, at Clarksburg. Robert R. Merhige, Jr., Senior District Judge, sitting by designation. (CR-89-235, CA-92-61-E).

David E. Talbert, appellant pro se.

Lisa Grimes Johnston, Office of the United States Attorney, Wheeling, West Virginia, for appellee.

N.D.W.Va.

AFFIRMED.

Before WILKINSON and MICHAEL, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

1

Appellant appeals from the district court's order denying his 28 U.S.C. Sec. 2255 (1988) motion. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Talbert, Nos. CR-89-235; CA-92-61-E (N.D.W. Va. Feb. 4, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
