I concur in the judgment of affirmance of the judgment below, denying the prayer of the petition for a new trial, but I desire to add that the evidence offered upon the hearing of this petition strongly confirms my former opinion in the main case that the verdict returned was the result of passion and prejudice on the part of the jury.
