(specially concurring). I concur in affirmance of the order. I agree that the defendant, upon the facts alleged, was engaged in the performance of a governmental function. While so engaged* under well settled principles of law, recognized and followed in this state, the defendant was not liable for its negligence. Montain v. Fargo, 38 N.
