concurring. Since the ordinance in question is clearly in violation of Section 5, Article XVIII of the Ohio Constitution, I would be inclined to dissent. However, appellants have not raised the issue and, therefore, it need not be confronted. Accordingly, I concur with Justice Sweeney’s well-reasoned opinion.
