concurred in the results of Baldwin’s
opinion. He was of opinion, that where the question is a proper one for the jury, and the Judge who presides at the trial approves the verdict, this Court should not reverse it.
Brooke, J. referred to his opinion in the case of Green v. Ashby, 6 Leigh 135, as expressing his views on the subject.
Cabell, P. should have given a different verdict; but was of opinion that the judgment should be affirmed.
