UNITED STATES of America, Plaintiff Appellee,
v.
Robert Leonard MORTON, Defendant Appellant.
No. 93-6926.
United States Court of Appeals, Fourth Circuit.
Submitted: July 12, 1994
Decided: October 14, 1994.
Appeal from the United States District Court for the Southern District of West Virginia, at Bluefield. Elizabeth V. Hallanan, District Judge. (CR-90-234, CA-93-215)
Robert Leonard Morton, Appellant Pro Se.
Hunter P. Smith, Jr., Assistant United States Attorney, Charleston, West Virginia, for Appellee.
S.D.W.Va.
AFFIRMED.
Before WIDENER and NIEMEYER, Circuit Judges, and BUTZNER, Senior Circuit Judge.
PER CURIAM:
Appellant appeals from the district court's order denying his 28 U.S.C. Sec. 2255 (1988) motion. Our review of the record and the district court's opinion adopting the magistrate judge's recommendation discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the district court. United States v. Morton, Nos. CR-90-234; CA-93-215 (S.D.W. Va. Aug. 20, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.
